TERMS AND CONDITIONS

1. Agreement to These Terms

These Terms and Conditions (“Terms”) govern access to and use of Artigem Streamline® (“Streamline,” “Service,” “Platform,” “we,” “us,” or “our”), an insurance claims estimating and contents-management platform provided by Artigem, INC. By accessing, registering for, or using Streamline, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

If you use Streamline on behalf of an insurance carrier, adjusting organization, vendor, or other business or organization, you represent that you are authorized to accept these Terms on its behalf. In that case, “you” includes both you and the organization you represent.

2. Description of the Service

Streamline is designed to support insurance claims professionals and authorized users with contents claims estimation, inventory management, valuation, pricing research, depreciation calculations, claim collaboration, document and image handling, and related workflow functions. Features may include automated or AI-assisted categorization, pricing recommendations, comparable-item searches, replacement information, and integrations with third-party claims systems and data sources.

Features may vary by customer, subscription, integration, carrier configuration, user role, claim type, geographic area, or other factors. Artigem, INC may add, modify, suspend, or discontinue features from time to time.

3. Eligibility and Authorized Use

You must provide accurate and current information when creating or using an account.

You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account.

You may use Streamline only for legitimate business, insurance claims, estimating, inventory, valuation, and related purposes for which you are authorized.

You must comply with all applicable laws, regulations, contractual obligations, carrier requirements, and professional standards.

You may not permit unauthorized individuals to access your account or use the Service.

You may not attempt to bypass security controls, interfere with the Service, reverse engineer the Platform, or access data or accounts without authorization.

4. Claims Estimates, Pricing, and Valuation Information

Streamline may provide pricing, valuation, depreciation, comparable-item, categorization, or other claim-related information based on data supplied by users, third-party sources, configured rules, algorithms, AI-assisted processes, market information, and other inputs.

Information generated by Streamline is intended to assist authorized claims professionals and is not, by itself, a promise or guarantee of a claim settlement, coverage determination, replacement cost, actual cash value, or payment amount.

Users are responsible for reviewing estimates, pricing results, depreciation, categorization, quantities, descriptions, comparable items, and other outputs before relying on them.

Actual claim decisions remain subject to the applicable insurance policy, carrier guidelines, adjuster review, applicable law, and other relevant facts.

Third-party prices, product availability, retailer information, and comparable-item data may change or become unavailable.

Artigem does not act as an insurance carrier, claims administrator, public adjuster, attorney, or other professional advisor solely by providing Streamline software.

5. User Content and Claim Information

Users may submit claim information, inventories, descriptions, photographs, receipts, documents, addresses, contact information, and other content (“User Content”). You retain any rights you have in User Content, subject to the rights necessary for Artigem, INC to provide and operate the Service.

You represent that you have the right and authorization to submit User Content to Streamline.

You authorize Artigem, INC to host, process, transmit, display, analyze, and otherwise use User Content as reasonably necessary to provide, maintain, secure, troubleshoot, and improve the Service and to perform services requested by authorized customers.

You are responsible for the accuracy, legality, and appropriateness of User Content.

You should not submit information that you are prohibited from disclosing or processing under applicable law or contract.

6. Privacy

Artigem, INC ‘s collection and use of personal information is described in the Artigem Streamline Privacy Policy. The Privacy Policy is incorporated by reference to the extent applicable.

7. SMS / Text Messaging Terms

This section applies when you provide a mobile telephone number and separately consent to receive SMS or text messages from Artigem, INC or when an authorized Streamline customer initiates an SMS workflow through Streamline. SMS messaging is intended primarily for transactional and service-related communications associated with claims, account access, invitations, workflow notifications, and customer support.

7.1 Types of Messages

Claim-related notifications, requests, reminders, or status updates.

Invitations or secure links to access a claim, inventory, portal, or Streamline workflow.

Account or authentication-related notifications, where applicable.

Customer support or service communications related to a Streamline request.

Other transactional messages that you have expressly requested or authorized.

Artigem, INC will not use consent to receive transactional SMS messages as authorization to send unrelated marketing or promotional text messages.

7.2 Message Frequency

Message frequency varies based on your interaction with Streamline, the claims or workflows in which you participate, and the notifications you have requested or authorized. You may receive multiple messages during an active claim or workflow and fewer or no messages when there is no relevant activity.

7.3 Message and Data Rates

Message and data rates may apply depending on your mobile carrier and service plan. Artigem, INC does not control or reimburse carrier charges. Supported carriers and availability may vary.

7.4 How to Opt Out – STOP

You can stop receiving Artigem, INC SMS messages by replying STOP to an Artigem, INC text message. After you send STOP, you may receive a one-time confirmation message, and no further messages will be sent through that SMS program unless you provide a new consent or otherwise initiate a message flow that requires SMS.

7.5 Help

7.6 SMS Consent and No-Sharing Commitment

SMS consent is not a condition of purchasing goods or services. Consent to receive text messages is specific to the applicable SMS program and does not authorize unrelated promotional communications.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8. Third-Party Services and Integrations

Streamline may integrate with or provide links to third-party systems, claims platforms, retailers, data providers, mapping services, communications providers, payment providers, or other services. Third-party services may have their own terms and privacy policies. Artigem, INC does not control third-party services and is not responsible for their availability, content, accuracy, security, or practices, except as expressly agreed in a written contract.

9. Intellectual Property

Streamline, including its software, user interface, workflows, documentation, designs, trademarks, logos, and underlying technology, is owned by Artigem, INC or its licensors and is protected by applicable intellectual property laws. Except for the limited rights expressly granted under these Terms or a written agreement, no rights are granted to you.

Artigem Streamline®, Artigem, INC, and related names and logos are trademarks or service marks of Artigem, INC or their respective owners. Third-party trademarks remain the property of their respective owners.

10. Prohibited Activities

Using the Service for unlawful, fraudulent, deceptive, or unauthorized purposes.

Attempting to gain unauthorized access to accounts, systems, networks, or data.

Introducing malware, malicious code, or other harmful material.

Interfering with or disrupting the Service or attempting to circumvent usage, security, or access controls.

Scraping, harvesting, or systematically extracting Service data except where expressly authorized in writing.

Reverse engineering, decompiling, disassembling, or attempting to derive source code except to the extent expressly permitted by applicable law.

Using automated systems to access the Service in a manner that materially burdens or disrupts the Platform.

Submitting content or personal information without the necessary rights, authorization, or lawful basis.

11. Security

Artigem, INC maintains administrative, technical, and organizational measures intended to protect information processed through Streamline. No system or method of electronic transmission or storage can be guaranteed to be completely secure. Users are responsible for maintaining the security of their credentials and devices and for promptly reporting suspected unauthorized access.

12. Service Availability and Changes

Artigem, INC will use commercially reasonable efforts to maintain the Service but does not guarantee that Streamline will be uninterrupted, error-free, continuously available, or compatible with every device, browser, integration, carrier, or third-party service. Artigem, INC may perform maintenance, updates, security changes, or other modifications that may temporarily affect availability.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND INFORMATION PROVIDED THROUGH THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ARTIGEM, INC DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

Artigem, INC does not warrant that pricing, product availability, comparable-item information, depreciation results, categorization, estimates, or other outputs will be complete, current, accurate, or appropriate for every claim or circumstance. Users remain responsible for professional review and claim decisions.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTIGEM, INC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

Any additional limitations, exclusions, or liability caps contained in a written master services agreement, subscription agreement, order form, or other contract between Artigem, INC and an enterprise customer will control to the extent of any conflict.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Artigem, INC and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your unauthorized use of the Service, violation of these Terms, violation of applicable law, or infringement of third-party rights through User Content or your use of the Service.

16. Suspension and Termination

Artigem, INC may suspend or terminate access to Streamline when reasonably necessary to protect the Service, users, data, or third-party systems; to address security or legal concerns; for material violations of these Terms; or as otherwise permitted by an applicable customer agreement. Upon termination, rights to access the Service will cease except as otherwise provided by contract or applicable law.

17. Changes to These Terms

Artigem, INC may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Where required by law or contract, Artigem, INC will provide additional notice. Continued use of the Service after an update becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.

18. Governing Law and Dispute Resolution

These Terms are intended to be governed by the laws specified in the applicable written agreement between Artigem, INC and the customer. If no such agreement specifies governing law or venue, Artigem, INC should complete this section with its counsel before publication to identify the intended governing law, venue, and dispute-resolution process.

19. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Failure to enforce a provision does not waive the right to enforce it later.

These Terms, together with any applicable written customer agreement and incorporated policies, constitute the agreement governing use of Streamline, subject to the order of precedence stated in the applicable customer contract.

These Terms do not create a partnership, joint venture, employment, agency, or fiduciary relationship between you and Artigem.

You may not assign your rights or obligations under these Terms except as permitted by an applicable written agreement. Artigem may assign these Terms as part of a merger, acquisition, reorganization, or transfer of substantially all relevant assets, subject to applicable law.
